Senior with ADHD needs legal assistance in Florida?


I live in Fort Myers Florida and filed a case in small claims court for the return of a rental security deposit.

This week the judge awarded the case to the landlord because I could not answer her questions fast enough.

I am 60 y.o. and have ADHD and receive disability income. When I am under stress my mind shuts down. I live alone and had no one to go to court to help me.

Now the landlord wants legal fees and court costs.

Does anyone know where I can find a lawyer that might help me? I have looked all thru the yellow pages and on the internet.

I spoke to the clerk at the courthouse when I filed and she could not direct me. I also spoke to people at the VA here in Fort Myers who gave me the name of a attorney. That attorney said he could not help and said he did not know where I could get any assistance.

I can't find any legal aid. I'm tried of trying. I guess they will take what little I have.

I guess you are right when you say "I guess they will take what little I have." The only realistic chance that you would have is possible but unlikely. There exists in the largest of law firms a manager or director of pro bono cases that the firm takes on a "freebie" basis. Call a few of the largest. They do care about fulfilling their civic obligations, and they have ulterior reasons, none of which would prejudice you or your case. It would be more of a needle in a haystack to try to find a private attorney, other than a relative, to help you free on a matter of such a relatively (to them) small finanicial impact. If you appeal, it must be done in a limited time, and you would receive a trial de novo (all new trial, not just based on the lower court's record, which there is none at the Small Claims Court level), at the county level, not the Small Claims Court. If you have the time, then don't piss it off; give it a whirl. Also, do a little legal research yourself, and find out what property you have that they can reach with their money judgment. You may not have any - and therefore you may be "judgment proof."
And they may not try to execute their judgment against you because everything you own is exempt for levy or attachment by money judgments.

You might also want to check with the senior citizens affairs office in your community to see if they have an advocate who can help.

bill if i were you what i would do is call legal-aid in florida and tell them you need legal assistance and since your on social security your eligible for free or reduced legal assistance . good luck
