Can I get fired from a job I just attained because I have diabetes in Quebec?


My friend has diabetes and he just got a job at Zellers and Not a week later he got fired for having diabetes. Is this allowed?

That's probably not why he was fired.
While I am not familiar with Canada's legal system, I highly doubt that people can be fired for having a medical condition.

What did he do at Zellers, and what is Zellers?

Work and diabetes

Having diabetes doesn鈥檛 mean that you cannot get or keep a job. Diabetes UK believes that everyone with diabetes should be assessed on their own merits and should not be subjected to blanket bans on certain jobs. Although there are fairly few jobs with blanket bans these days we still believe there are too many.

The Disability Discrimination Act (DDA) was brought in to protect people with disabilities from being treated differently to other employees. Although most people with diabetes do not consider themselves disabled, diabetes is covered under the Act. If you feel you鈥檝e been refused a job and you think that it鈥檚 solely because of your diabetes, it may be worth appealing the decision. This is also true if you鈥檝e been diagnosed with diabetes, already in a job and find that you are being moved to another job or discharged on medical grounds.

There is no legal requirement to tell your employer or potential employer that you have diabetes but by doing so it will probably make it easier to arrange clinic appointments and manage your condition.

I agree with Phil here....no you cannot be fired due to a medical condition. Unless you didnt tell them when you applied for the job, what does your job involve? It really depends on what job you do but in the UK being in the armed forces you cannot be a diabetic. Am unsure about other jobs but a police officer you can be a diabetic as long as you can prove you are really good at controling it.

For some jobs it is. Drivers, machine operators, armed forces, police, firefighters, pilots, air traffic controllers, anything that requires constant alertness and where high or low blood glucose could result in danger to those the job serves.

No way. Ever. If the person has direct proof that this is the cause of firing, let her make a case for it. Go to the Tribunal du Travail, get a lawyer, whatever.
